Terms of Use
These Terms of Use apply to technicade.tech, Technicade software products and subdomains, subscriptions, customer support, service requests, repair or technical services, and other products or services provided under the Technicade brand.
1. Acceptance of these terms
By accessing or using a Technicade website, creating an account, purchasing a subscription, submitting a service request, or otherwise using a Technicade product or service, you agree to these Terms of Use. If you use Technicade on behalf of a business or organization, you represent that you have authority to bind that organization to these terms.
2. Technicade products and services
Technicade may provide software-as-a-service products, websites, operational tools, maintenance and reminder tools, checklist and reporting tools, technical support, electronics troubleshooting, 3D printing, custom parts, software assistance, arcade-related services, and other practical technical services. Features, availability, pricing, and supported use cases may change over time.
3. Software is an administrative tool
Technicade software is intended to assist with organization, recordkeeping, reminders, checklists, maintenance tracking, reporting, and related workflows. Unless expressly stated otherwise, it is not an emergency service, safety system, legal compliance system, medical service, accounting service, payroll system, certified inspection service, or substitute for qualified professional judgment.
You remain responsible for your operations, workplace procedures, maintenance decisions, safety practices, legal and regulatory obligations, employee supervision, and verification of any information or records produced through the service.
4. Accounts and workspace access
You are responsible for safeguarding account credentials and for activity performed through your account or workspace. Workspace owners and administrators are responsible for managing user access, roles, permissions, and invitations. You must ensure that users you invite are authorized to access the applicable workspace and information.
5. Customer content
You retain ownership of text, photos, files, responses, records, and other content you submit. You grant Technicade a limited right to host, process, transmit, display, back up, and otherwise handle that content as reasonably necessary to operate, secure, support, and improve the service. You are responsible for ensuring that you have the rights and permissions needed to upload the content.
6. Acceptable use
You may not use Technicade products or services to violate law, infringe another person's rights, upload malicious software, attempt unauthorized access, interfere with service operation, abuse other users, misrepresent records, circumvent plan limits or security controls, or use the service in a way that creates unreasonable risk to Technicade or others.
7. Subscriptions, trials, and billing
Paid software plans may be billed on a recurring basis through Stripe. The price, billing interval, and any trial period are shown at checkout. Unless otherwise stated, subscriptions automatically renew until canceled. You may manage or cancel eligible subscriptions through the billing portal. Cancellation generally takes effect at the end of the current billing period. Charges already incurred are non-refundable except where required by law or expressly stated otherwise.
8. Service quotes and project work
For repair, technical support, 3D printing, electronics, installation, custom parts, or other project-based work, prices shown on Technicade websites may be starting prices or estimates. Additional labor, materials, parts, shipping, travel, design revisions, prototypes, or expanded scope may require a separate quote or approval before work continues.
9. Safety-critical and regulated work
Technicade may decline work that is safety-critical, structural, high-voltage, pressure-bearing, medical, regulated, or otherwise outside the reasonable scope of the service. 3D-printed or custom replacement parts may not be appropriate for every application. You are responsible for determining whether a part or service is appropriate for your intended use.
10. Third-party services
Technicade relies on third-party providers for hosting, authentication, databases, storage, email, analytics, payments, and other infrastructure. We are not responsible for outages, service changes, security incidents, or actions of third-party providers that are outside our reasonable control.
11. Availability and changes
We may modify, improve, suspend, or discontinue products, features, or services from time to time. We do not guarantee uninterrupted or error-free operation, delivery of every notification or email, preservation of every record, or compatibility with every device, browser, or third-party service. You are responsible for maintaining any independent records or backups your business requires.
12. Disclaimer of warranties
To the maximum extent permitted by law, Technicade products and services are provided “as is” and “as available.” Technicade disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and any warranty arising from course of dealing or usage of trade.
13. Limitation of liability
To the maximum extent permitted by law, Technicade and its operators, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost revenue, business interruption, loss of data, missed reminders, missed tasks, missed notifications, workplace incidents, lost opportunities, or decisions made in reliance on a Technicade product or service.
To the maximum extent permitted by law, Technicade's total aggregate liability arising out of or relating to a product or service will not exceed the greater of (a) the amount you paid to Technicade for the applicable product or service during the twelve months before the event giving rise to the claim or (b) US $100. Some jurisdictions do not permit certain limitations, so these limits apply only to the extent permitted by law.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Technicade and its operators from third-party claims, damages, liabilities, costs, and reasonable legal fees arising from your unlawful use of the service, your content, your violation of these terms, or your violation of another person's rights.
15. Suspension and termination
Technicade may suspend or terminate access for fraud, abuse, unlawful activity, security risk, nonpayment, or material violation of these terms. You may stop using Technicade services at any time, subject to any outstanding payment obligations or agreed project commitments.
16. Intellectual property
Technicade's software, branding, designs, website content, and other materials are protected by applicable intellectual-property laws. These terms do not transfer ownership of Technicade intellectual property to you. You may use the service only as permitted by these terms and the applicable product.
17. Governing law
Except where applicable law requires otherwise, these terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles.
18. Changes to these terms
Technicade may update these Terms of Use as products and services evolve. The “Last updated” date above will be revised when changes are made. Continued use after updated terms take effect constitutes acceptance to the extent permitted by law.
